Hi Forum,
My wife has an H1B visa which has been invalidated now because she had to travel to US with me on H4. Her petition seem to be valid. The I94 in her passport has H4 mentioned on it. Now we want to convert her visa back to H1. Since she has H1, I am wondering the H4 to H1 conversion process should be easier compare to applying fresh H1.
It would be great if you guys let me know what is the process of converting this without going back to home country.

If I understand it right.. The whole House of Reps is up for re-elections every 2 years and 1/3 senate members get reelected at the same interval too...
Does any one know what happens to pending bills at the time of elections..Specifically regarding S2611...If say the conference committee reaches a compromise just before elections but for some reason they dont get to take a vote on it... Does the new senate and house carry the bill forward from that point or does the bill gets reset ?

Article says "On June 12, 2008, U.S. Citizenship and Immigration Services (USCIS) informed the American Immigration Lawyers Association that the H-1B random selection process has been completed. USCIS completed the intake and receipt processes for all filings as of May 24, 2008 and began mailing rejection notices the week of June 9. Therefore, if an employer has not yet received a filing confirmation (Form I-797C Notice of Action), it likely means that the petition was not selected in the random process and that the rejection notice will be forthcoming."

Some big compromises in the House version that dropped this morning. First, there will be $2525 in filing fees, $525 of which is due at the outset and $2000 of which is paid five years in to the ten year conditional non-immigrant period. That should presumably answer critics who complain that DREAM will add to the deficity. I believe finger print needs to be obtained somehow to varify the person. Hope it is not damaged too much. Why dont you try to obtain a doctor's letter stating that she had some blisters and is recovering? Usually for ladies it shouldn't be much of an issue but just as a precaution. The POE officers are usually good towards Indian ladies, particularly when they travel alone. So dont worry too much.

hi guys,
during stage 3, they require a birth certificate. what if I dont have a birth certificate? do they accept an affidavit from my parents with a domicile cerrtificate or not? i dont even have a school leaving certificate. please give me advices.

No. Wife's status change is independent of husband. H1 status of husband is not invalidated by wife's use of EAD.

I was reading some info abt EAD on this site and have come to know that Once H4 visa holders get their EAD's can work after getting SSN.But I read that If H4 visa holders start working as soon as they got EAD's.Does this invalidate H1 visa status if wife starts working on EAD.Please clarify my doubt.

I entered U.S with B1/B2 visa and got changed into F1 status. While F1 status got approved
I departed U.S due to family matter.
Now I'd like to make it sure that my B1/B2 visa is still valid,because I plan to visit to my friend who lives in U.S.
How to check my B1/B2 visa could be remained still valid?

Guys I will be going for my first H1 visa stamping in New Delhi. I am currently in the US. I transfered from F1 to H1. Have been looking into documents to take to the interview, and looking at so many 221(g) cases, have been confused by this term "unemployment wage report". I would really appreciate it very much if someone could please tell me what is "unemployment wage report" and how is different then "prevailing wage report"? Also, do I need to take both of them to the visa interview? Thanks!
